Terms of Service

1. The service

CheapBulkSMS provides a web panel and API for sending SMS and RCS messages to mobile numbers in India through upstream carrier routes. Delivery times and rates shown on the site are typical figures, not guarantees; actual delivery depends on telecom operators and recipient handsets.

2. Your account

• You must provide accurate information and keep your login credentials and API tokens confidential.
• You are responsible for all activity under your account and tokens, including charges incurred.
• Accounts are for business use by persons aged 18 or over.

3. Acceptable use — your responsibilities

• You confirm you have obtained valid consent from every recipient to receive your messages.
• You are solely responsible for the content of your messages and for complying with all laws and regulations applicable to you and your recipients, including telecom and consumer-protection rules.
• You must honour opt-out requests promptly and maintain your own suppression lists.
• You must not use the service for unlawful, fraudulent, deceptive or harassing messages.

4. Prohibited content

We may suspend or terminate accounts sending prohibited content without refund, and may report unlawful activity to authorities.

• Phishing, scams, or impersonation of banks, government bodies or other organisations.
• Content related to illegal gambling, illegal lotteries, loan fraud or financial scams.
• Adult content, hate speech, threats or incitement of violence.
• Malware links or attempts to collect credentials deceptively.

5. Credits, pricing and payment

• Services are prepaid. The minimum order is 5,000 SMS; current rates are shown on the pricing page and may change with notice.
• Credits are deducted per message segment sent. Messages that fail at the gateway are not charged.
• Credits do not expire but are non-transferable between accounts.
• Prices exclude applicable taxes (such as GST) unless stated otherwise.

6. API usage

API tokens may be created and revoked from your dashboard. We may apply fair-use rate limits to protect platform stability. Abusive traffic patterns may result in throttling or suspension.

7. Availability and support

We aim for high availability but the service is provided 'as is' and 'as available'. Scheduled maintenance and factors outside our control (carrier outages, force majeure) may affect delivery.

8. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service is limited to the amount you paid us in the three months preceding the claim. We are not liable for indirect, incidental or consequential damages, or for the content of messages you send.

9. Termination

You may stop using the service at any time. We may suspend or terminate accounts that breach these terms. On lawful termination for breach, remaining credits may be forfeited; otherwise the refund policy applies.

10. Governing law

These terms are governed by the laws of India. Courts at the company's registered place of business shall have exclusive jurisdiction.
